Who it is for
The Italian Crisis and Insolvency Code makes the procedure available to commercial and agricultural entrepreneurs facing financial or economic imbalance where recovery appears reasonably achievable. There is no annual application window; the individual situation and timing matter.
First: map cash
List expected receipts and payments week by week. Separate issued invoices from likely cash receipts. Credible negotiations require verifiable numbers.
Second: map debts
Separate banks, suppliers, employees, tax authorities and collection agents. Record amount, due date, security, disputes and payments for each position.
Third: identify workable changes
Identify profitable activities, cash drains and feasible responses: cost changes, asset sales, new finance or revised payment schedules. The assumptions should be documented.
Application and the expert
Applications use the national platform operated by the chamber-of-commerce system. The platform specifies the required documents and information. An independent expert assists negotiations and assesses recovery prospects with the parties; the entrepreneur continues to manage the business.
Protective measures are not automatic
Access to the procedure does not by itself stop every creditor action. Protective measures require the steps set out in the Code and court scrutiny. Their duration, effect and limits need case-specific professional assessment.
Practical next step
Gather financial statements, up-to-date accounts, a cash plan, creditor list and key contracts. Before applying, assess recovery prospects and urgent negotiations with qualified advisers.
